1 - Binding Agreement
These Terms & Conditions constitute a legally binding agreement between the client (“Client”) and aleVSham Travel Collection or its authorized operating partner.
By confirming a booking, the Client acknowledges having read, understood, and accepted these Terms & Conditions in full.
2 - Booking & Payment Terms
A booking shall be deemed confirmed only upon:
•Receipt of the required deposit; and
•Issuance of written confirmation by the Company.
A standard deposit of 30% to 40% of the total tour cost is required unless otherwise specified.
The balance payment must be received no later than 30 to 45 days prior to arrival.
For peak seasons, restricted regions, high-demand festivals, palace stays, special events, or journeys requiring special permits, full advance payment may be required.
All payments must be made through approved banking channels. Bank charges, currency conversion fees, and transaction costs shall be borne by the Client.
3 - Pricing & Adjustments
Prices are based on prevailing government taxes, statutory levies, supplier tariffs, exchange rates, and fuel costs at the time of quotation.
In the event of significant changes in tax structures, exchange rates, fuel prices, or supplier tariffs beyond the Company’s reasonable control, prices may be revised prior to receipt of full payment.
4 - Travel Insurance
Comprehensive travel insurance is mandatory for all Clients. Coverage must include:
•Medical expenses
•Emergency evacuation (particularly for high-altitude Himalayan regions)
•Personal liability
•Trip cancellation and interruption
The Company shall not be liable for any losses arising from inadequate insurance coverage.
5 - Health & Fitness
Certain journeys may involve remote locations, high altitudes, or physically demanding conditions.
The Client acknowledges responsibility for ensuring medical fitness prior to travel and agrees that the Company shall not be liable for health-related complications arising during the journey.
6 - Role of the Company
aleVSham Travel Collection acts solely as a facilitator and coordinator between the Client and independent third-party service providers, including airlines, hotels, transport operators, guides, and activity providers.
The Company does not own, operate, or control these entities.
7 - Limitation of Liability
To the maximum extent permitted under Indian law, the Company shall not be liable for:
•Loss, injury, accident, or illness
•Delays, cancellations, or schedule changes
•Force majeure events
•Natural disasters or weather disruptions
•Political disturbances or government restrictions
•Airline or transport disruptions
•Acts or omissions of third-party service providers
8 - Force Majeure
Force majeure includes, but is not limited to:
•Natural calamities
•Pandemics or public health emergencies
•Government travel restrictions
•War or civil unrest
•Strikes or labor disputes
•Road closures
•Severe weather conditions affecting safety
Under such circumstances, the Company shall not be held liable for non-performance.
9 - Itinerary Changes
The Company reserves the right to modify itineraries due to safety concerns, operational requirements, or circumstances beyond reasonable control. Reasonable alternatives shall be provided where feasible.
10 - Jurisdiction
All disputes arising from bookings shall be subject to the exclusive jurisdiction of the competent courts in India.
